Affiliate Program Terms of Service

These Affiliate Program Terms of Service ("Affiliate Terms") govern your participation in the Forex Fundamentals Affiliate Program (the "Program"). The Program is operated by FMA Data Solutions B.V., trading as Forex Fundamentals (the "Company", "we", "us"). By applying for or participating in the Program, you agree to be bound by these Affiliate Terms, in addition to our general Terms & Conditions and Privacy Policy. If there is any conflict between these Affiliate Terms and the general Terms & Conditions, the Affiliate Terms prevail with respect to affiliate matters.

Chapter 1: Programme Overview

The Forex Fundamentals Affiliate Program allows approved partners ("Affiliates") to earn commissions by referring new paying customers to the Service. The Program is managed through Tolt, our affiliate tracking platform. By joining the Program, you receive a unique affiliate link and access to the Tolt affiliate dashboard where you can monitor clicks, conversions, and earnings.

Chapter 2: Eligibility and Acceptance

To participate in the Program, you must apply and be approved by us. We reserve the right to accept or reject any application at our sole discretion and without obligation to provide reasons. You must be at least eighteen years of age and have the legal authority to enter into binding agreements. We may request additional identification or business information before or during your participation. Acceptance into the Program does not guarantee continued participation; we may revoke access at any time in accordance with Chapter 9.

Chapter 3: Commission Structure

Commission rates are agreed upon individually between you and the Company prior to or at the time of acceptance into the Program. Your specific commission rate will be communicated to you in writing (including via email or through the Tolt affiliate dashboard) and may vary depending on factors such as volume, audience type, and negotiated terms. Unless otherwise agreed in writing, commissions are earned on qualifying paid subscriptions only; free trials, refunded transactions, and chargebacks do not qualify for commission.

A "qualifying referral" means a new customer who (a) clicks your unique affiliate link, (b) signs up for the Service within the cookie window defined in Chapter 4, and (c) completes at least one successful paid transaction. Commissions are calculated on the net revenue received by the Company (excluding taxes, fees, and chargebacks). Self-referrals are not permitted.

Chapter 4: Cookie Duration and Attribution

When a prospective customer clicks your affiliate link, a tracking cookie is placed on their device with a duration of thirty (30) days. If the prospective customer completes a qualifying purchase within this 30-day window, the referral is attributed to you. If the cookie expires before a purchase is made, no commission is earned. Attribution follows a last-click model: if a customer clicks multiple affiliate links from different affiliates, the commission is awarded to the affiliate whose link was clicked last before the purchase. We rely on Tolt for tracking and attribution; any technical limitations of the tracking platform are beyond our control and do not create additional obligations on our part.

Chapter 5: Payments and Minimum Threshold

Commissions are paid out on a monthly basis, within thirty (30) days after the end of each calendar month. The minimum payout threshold is $50 USD. If your accrued commissions at the end of a month are below this threshold, the balance will carry over to the following month until the threshold is met. Payments are processed via the payment method(s) available through the Tolt platform (e.g., PayPal or bank transfer). You are responsible for providing and maintaining accurate payment information. We are not responsible for delays or failures caused by incorrect payment details.

Commissions are subject to a sixty (60) day hold period from the date of the qualifying transaction before they become payable, to account for potential refunds or chargebacks. If a referred customer obtains a refund, initiates a chargeback, or cancels within this hold period, the associated commission will be reversed. You are solely responsible for any tax obligations arising from commissions earned under this Program.

Chapter 6: Promotional Guidelines

As an Affiliate, you agree to promote the Service honestly, accurately, and in compliance with all applicable laws and regulations. You must clearly disclose your affiliate relationship in any content where you promote or link to the Service, in accordance with applicable advertising and consumer protection laws (including but not limited to FTC guidelines and EU consumer directives). You may not:

  • Make false, misleading, or exaggerated claims about the Service, its features, or its outcomes;
  • Imply that the Service provides financial advice, trading signals, or guaranteed returns;
  • Use spam, unsolicited emails, or bulk messaging to promote your affiliate link;
  • Engage in cookie stuffing, click fraud, or any form of artificial traffic generation;
  • Bid on "Forex Fundamentals" or similar branded keywords in paid search campaigns (e.g., Google Ads, Bing Ads) without prior written permission;
  • Use misleading domain names, social media handles, or ad copy that could be confused with official Company channels;
  • Promote the Service on websites or platforms that contain illegal, harmful, defamatory, discriminatory, or adult content;
  • Offer unauthorized incentives, cashbacks, or rebates funded from your commission to induce sign-ups.

We reserve the right to review your promotional methods and materials at any time and to require modifications or removal of content that we determine, at our reasonable discretion, to be non-compliant with these terms.

Chapter 7: Intellectual Property and Branding

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Forex Fundamentals name, logo, and approved marketing materials solely for the purpose of promoting the Service under the Program. You may not alter, modify, or create derivative works of our branding materials without prior written consent. All intellectual property rights in the Service, content, data, and branding remain the exclusive property of the Company. This licence terminates immediately upon your exit from the Program, whether voluntary or by termination.

Chapter 8: Relationship of the Parties

You are an independent contractor. Nothing in these Affiliate Terms creates an employment, partnership, joint venture, or agency relationship between you and the Company. You have no authority to make commitments, representations, or warranties on behalf of the Company. You are solely responsible for your own expenses, equipment, and compliance with applicable laws in connection with your participation in the Program.

Chapter 9: Suspension and Termination

Either party may terminate participation in the Program at any time, for any reason, by providing written notice (including email). We may suspend or terminate your participation immediately and without prior notice if we reasonably believe that you have violated these Affiliate Terms, engaged in fraudulent activity, or caused reputational harm to the Company. Upon termination:

  • Your affiliate link will be deactivated and no further referrals will be tracked;
  • Outstanding commissions that have cleared the hold period and meet the minimum payout threshold will be paid within sixty (60) days of termination;
  • Unpaid commissions below the minimum threshold at the time of termination are forfeited;
  • You must immediately cease all use of our branding, marketing materials, and intellectual property;
  • Any commissions attributable to fraudulent referrals will be reversed and may be subject to recovery.

Chapter 10: Liability and Indemnification

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the Program, including lost commissions due to tracking errors, technical failures, or third-party platform issues. Our total aggregate liability to you in connection with the Program is limited to the total commissions actually paid to you in the three (3) months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless the Company and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your participation in the Program, your promotional activities, or any breach of these Affiliate Terms.

Chapter 11: Modifications

We may modify these Affiliate Terms at any time by posting an updated version on this page with a revised "Last updated" date. Material changes will be communicated via email or through the Tolt dashboard. Your continued participation in the Program after notification constitutes acceptance of the modified terms. If you do not agree with a modification, your sole remedy is to terminate your participation as described in Chapter 9.

Chapter 12: Governing Law and Jurisdiction

These Affiliate Terms are governed by the laws of the Netherlands. Disputes shall be submitted to the competent court in Amsterdam, to the extent mandatory law does not provide otherwise. If any provision of these Affiliate Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. These terms are provided in English; translations, if any, are for convenience only, and the English version controls.
